Reservation To OBCs, Others In Local Body Polls Must Be Within 50% Limit: HC

Hyderabad: The Hyderabad High Court today issued an interim order directing the Telangana government to ensure that reservation to OBCs and others in the coming local body elections is as per the overall 50 per cent quota fixed by the Supreme Court.

A division bench directed the state government to adhere to the outer ceiling limit for providing reservation to other backward classes (OBCs) and other communities in local body polls. The bench also directed that under no circumstances it can be varied for providing reservation. The interim order was issued on a petition filed by A Gopal Reddy, an agriculturist from Nagarkurnool district.

The petitioner claimed that the state government was proposing to conduct elections to local bodies on the basis of quota which is far in excess of the 50 per cent upper ceiling limit fixed by the Supreme Court.

The bench, comprising Chief Justice Thottathil Bhaskaran Nair Radhakrishnan and Justice Ramesh Ranganathan, observed that the 50 per cent outer limit for providing reservation is mandatory in view of the apex court judgment.

It cannot be exceeded except in cases where provision of reservation to scheduled tribes in scheduled areas are concerned, it said. The bench directed the state government to file a counter affidavit and adjourned the matter. (PTI)
